General Terms and Conditions

Aureus Retreats Pty Ltd
(“Aureus Retreats”, “the Company”, “we”, “our”, “us”)
Effective as of: 10 October 2025

1. Booking and Payment

1.1 A booking is confirmed once full or partial payment (as stated on the retreat booking page) has been received by Aureus Retreats Pty Ltd.
1.2 All prices are in Australian Dollars (AUD) and include GST where applicable.
1.3 The remaining balance (if applicable) must be paid by the date specified in the booking confirmation. Failure to make payment may result in cancellation of your booking.

2. Cancellation Policy

2.1 Participant cancellation:
- More than 60 days before retreat start: full refund minus a $250 administration fee.
- 30–59 days before retreat start: 50% refund of total booking cost.
- Less than 30 days: no refund available.

2.2 Transfer of booking: Participants may request to transfer their booking to another person up to 14 days before the retreat begins, subject to Company approval.

2.3 Company cancellation: In the unlikely event that Aureus Retreats cancels a retreat (e.g., due to insufficient enrolments, force majeure, or safety concerns), participants will receive a full refund or credit toward a future retreat. We are not responsible for any other expenses (e.g., flights or accommodation) incurred by participants.

3. Weather and Program Modifications

3.1 Participants acknowledge that retreat activities may take place outdoors and are subject to weather and environmental conditions beyond our control.
3.2 In the event of adverse weather (e.g., heavy rain, extreme heat, or unsafe conditions), Aureus Retreats reserves the right to:
- modify, reschedule, or relocate tennis or outdoor sessions, or
- replace affected activities with suitable alternatives (e.g., indoor training, workshops, wellness sessions).
3.3 Such changes do not constitute a breach of contract, and participants are not entitled to a refund or compensation where a reasonable alternative has been provided.

4. Participant Responsibilities

4.1 Participants are responsible for ensuring that they are physically fit and medically able to participate in retreat activities.
4.2 Any medical or dietary conditions must be disclosed prior to the start of the retreat.
4.3 Aureus Retreats reserves the right to refuse participation if a participant is deemed unfit, poses a safety risk, or fails to comply with instructions.

5. Health, Safety, and Liability

5.1 Participation in physical activities carries inherent risks. By joining a retreat, you accept responsibility for your own health, safety, and wellbeing.
5.2 To the extent permitted by law, Aureus Retreats Pty Ltd, its directors, officers, employees, and contractors shall not be liable for any injury, loss, damage, or expense arising from your participation, except where such liability cannot be excluded under the Australian Consumer Law (ACL).
5.3 Nothing in these terms limits rights that cannot legally be excluded, including guarantees under the ACL regarding the provision of services with due care and skill.

6. Insurance

Participants are strongly encouraged to obtain their own travel and health insurance that covers cancellation, injury, and personal property.

7. Accommodation and Third-Party Services

Where accommodation, catering, or transport is provided by third parties, Aureus Retreats acts only as an intermediary. The terms and conditions of those providers apply, and Aureus Retreats is not liable for their acts or omissions.

8. Photography and Media

Participants consent to the use of photos and video recordings taken during the retreat for marketing and promotional purposes, unless written notice opting out is provided before the retreat begins.

9. Force Majeure

Aureus Retreats is not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, pandemic restrictions, fire, flood, government actions, or other force majeure events.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and any disputes shall be subject to the exclusive jurisdiction of the courts of that state.

11. Acceptance

By booking and paying for a retreat, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
